Introduction

Just Cannabis an online retails store which can be accessed at www.just-cannabis.co.za and is owned and operated by Just Cannabis (Pty) Ltd (hereinafter referred to as either “Just Cannabis”, “us”, “our” or “we”).

 

Use of Website

 

By using this website you agree that you are 18 years of age or older and that you are familiar with these terms and conditions and accept them.

 

Only registered users are allowed to order products on this website. In order to register you must provide a username, password and certain personal information to Just Cannabis. You hereby agree to keep your user name and password secret and not to disclose it to any third party.

 

You hereby agree that if your secret username and password for your account have been entered, you will be held liable for payment of such order, irrespective of whether the use of your username and password is fraudulent or without proper authority.

 

The information contained in this website may not be copied, published, printed, posted, displayed or otherwise used without the written consent of Just Cannabis.

 

 

Sales and Stock Availability

 

Only registered users may place a valid order on Just Cannabis website, which order may be accepted or rejected by Just Cannabis. Factors that influence Just Cannabis’s acceptance or rejection of an order include: receipt of payment for the products by Just Cannabis, the availability of stock and the accuracy of the information relating to the products.

 

The acceptance of your order by Just Cannabis will be indicated by delivery of the products and no agreement will come into being until you receive delivery of the products. Should the product not be in stock, Just Cannabis will contact you to offer a replacement item, in the event that you are not happy with the replacement product offered, Just Cannabis will refund you any amount already paid.

 

Stock of all products offered on Just Cannabis’s website is limited. Just Cannabis will try to ensure that stock is always available and that the listing of the product on their website is deleted when stock runs out, but we cannot guarantee the availability of stock. You cannot hold Just Cannabis liable if Products are not available or are not available at the specific price when you attempt to complete the sales process at a later stage.

 

The ordering process will only commence once Just Cannabis receives your confirmed order and full payment. Putting products into the virtual shopping basket on Just Cannabis’s website without completing the sales process (including without limitation payment to Just Cannabis) does not constitute a valid order for the products and as such products maybe be removed from your shopping basket if the product is no longer available or the price of the product may be changed without notice to you.

 

 

Delivery

 

Just Cannabis dispatches orders daily (on business days). Orders which are received before 2 pm will be dispatched on the same day. If your order is placed after 2 pm it will be dispatched on the following business day.

Delivery to Major Cities will be effected within 4 days from date of dispatch. Delivery to Regional areas will be delivered within 6 working days from date of dispatch. We make every effort to ensure that you receive your parcel as soon as possible, however unforeseen circumstances may cause delays. Just Cannabis takes no responsibility for any delay in delivery or any loss or damage, of any kind whatsoever, arising from or in connection with any delay in delivery of your order.

Our couriers deliver between 8 am and 5 pm on business days only. No orders are processed or delivered on public holidays or over weekends.

In the event that the courier is unable to effect delivery due to the recipient not being at the specified delivery address, or due to the client furnishing Just Cannabis with an incorrect or incomplete delivery address, the parcel will be returned to us. In this instance Just Cannabis will make every effort to contact you and rearrange the delivery, however we may charge a reshipping fee, at our discretion.

Products are only for sale to customers who reside in South Africa and we do not deliver outside the borders of South Africa.

Prices of standard delivery is dependent on your area and the specific product ordered and will be disclosed to you during the checkout process.

 

 

Products excluded from standard delivery:

 

Due to the bulky nature and weight of Just Cannabis’s Craft soil (30 dm) product, it is excluded from the standard delivery terms and prices as contained on our website.

 

Just Cannabis’s Craft soil (30 dm) product can however be ordered through our online order form and can be collected from one of our depots.

 

 

Payment and Pricing:

 

Payment can be made by one of the following methods:

 

Credit Card:

We accept Visa and MasterCard credit card. Where payment is made via credit card we may require additional information to verify or authorize the payment. In the event that such a requirement of additional information arises Just Cannabis has the right to delay delivery until the additional information and payment authorization is obtained by Just Cannabis. In the absence of receipt by Just Cannabis of the required authorization your order for the products will be cancelled. By making use of the credit card payment option you warrant that you are authorized to use the credit card and that you have sufficient funds available on the card to pay for the products ordered.

 

EFT (Electronic Fund Transfer) or direct bank deposit:

When making an EFT or direct bank deposit please make use of your unique order number in the reference line for your payment. Payment must be made within 5 (five) days of placing your order, failing which Just Cannabis will not accept your order if payment has not been made.

 

Once you have selected your payment option you will be directed to a secure site link for payment of the relevant purchase price of the products.

 

 

Returns and Refunds Policy:

 

7 Day Cooling off period:

All products are sold subject to a 7 day cooling off period. This means that if you are dissatisfied with your purchase you can contact us within 7 days of receipt with the reason for your dissatisfaction. .

We unfortunately do not except returns that are not sealed in their original packaging, unless the product is damaged or defective.

Shipping costs for the return will be for your account.

Upon receipt, we will inspect the item and if it is in its original sealed state, we will refund you the value of the product.

 

Damaged Products:

In the event that a product is damaged or faulty when you receive it, you must notify us within 1 working day of receipt. Just Cannabis will then arrange to collect the product from you. A soon as we have inspected the product and authenticated your return, we will at your choice replace the product as soon as possible or credit your account with the purchase price of the product or refund you, if that is your preference.

 

Incorrect Products delivered:

If you receive the incorrect/ wrong product you must notify Just Cannabis within 1 working day of receipt. We will then check our system to see whether an error has occurred. If there was an error we will arrange to exchange the incorrect product for the one actually ordered at our cost.

 

Defective Products:

A defect is a material flaw in the production of a product or any characteristic of a product, which makes the product less acceptable then reasonably expected under the circumstances.

The following is not regarded as defects and will not entitle you to a return: damage due to incorrect usage of the product or negligence, damage due to a failure to adequately care for the product, damage due to unapproved modifications to the product, where the specifications of a product, despite being accurately described on the website, do not suit you, defects due to normal wear and tear.

 

Standard Defect Warranty:

If you have received a product which turns out to be defective please notify us as soon as possible after you become aware of the defect, but in any event within 30 days after delivery / collection of the product.

Please contact us to report a defective product, and we will arrange to collect the product from you. Once we have inspected the product and validated your return, we will at your choice repair / replace the product (if such repair is possible / we have the same product in stock to use as a replacement) or credit your account with the purchase price of the product or refund you, if that is your preference.

 

Privacy Policy

 

We respect your privacy and are committed to taking reasonable steps to protect it.

 

Just Cannabis will treat your personal information as strictly confidential and take appropriate measures to ensure that your personal information is kept safe.

 

We are however entitled to disclose your personal information to a third party under the following circumstances:

• In order to comply with any relevant law, subpoena, court order, legal process or to protect our property rights.
• In case of a fraudulent online payment, Just Cannabis is entitled to disclose relevant personal information for criminal investigation purposes.
• In case of defective products we are entitled to disclose your personal information to our supplier in order for them to deal with you directly regarding the defective product.

 

 

Changes to Terms and Conditions

 

Just Cannabis reserves the right to change any of these terms and conditions at its own discretion. It is your responsibility to regularly check the terms and conditions of this website. By using the website after changes to these terms and conditions have been displayed on it, you will be deemed to have accepted the changes.

 

 

Exclusion and limitation of liability

 

JUST CANNABIS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL LOSS OR DAMAGES WHICH COULD ARISE FROM YOUR RELIANCE ON OR USE OF THIS WEBSITE OR YOUR INABILITY TO USE THIS WEBSITE.

 

Just Cannabis shall not be liable for any erroneous information or prices displayed on the website, except in so far as the liability is the result of deliberate or negligent act or omission on behalf of Just Cannabis, it’s agents, employees and lawful representatives.

 

Disclaimer

 

Although Just Cannabis takes reasonable steps to ensure that the content of this website is accurate, Just Cannabis does not make any representations nor does it give any warranty, as to the safety, reliability, accuracy, correctness or completeness of the information on this website or as to the availability, functionality or integrity of this website.

 

Just Cannabis disclaims liability for any loss or damage, of any kind whatsoever, arising from or in connection to your use of this website or your reliance on any content or information on the website unless otherwise provided by law.

 

Despite the fact that certain products featured on this website may be under specific product warranty, this website and all the information contained therein is provided “as is” without warranty of any kind.

 

General

 

These terms and conditions and the relationship between the parties and/ or any dispute arising from or in relation to these terms and conditions will be in all respects be governed by and construed under the laws of the republic of South Africa.

 

If any provision of these Terms and Conditions is found to be unenforceable for whatever reason, then such provision shall be deemed to be severable from the remainder of these Terms and Conditions.

 

No indulgence granted nor waiver made by Just Cannabis shall be of any force and effect unless recorded in writing and signed by loss or damage, of any kind whatsoever, arising from or in connection Just Cannabis.

 

No variation of these Terms and Conditions shall be of any force and effect unless recorded in writing and signed by both parties.

 

You may not cede, assign or delegate your rights and obligations under these terms and conditions to a third party.
